Obama Administration To Argue In Court That They Can Spy On Americans With Impunity
The Obama administration is set to argue to a federal appeals court Friday that the government may breach, with impunity, domestic spying laws adopted in the wake of President Richard M. Nixon’s Watergate scandal.
The case tests whether Americans may seek recourse or monetary damages when a sitting U.S. president bypasses Congress’s ban on warrantless spying on Americans — in this instance when President George W. Bush authorized his secret, warrantless domestic spying program in the aftermath of the September 2001 terror attacks.
The government appealed to the 9th U.S. Circuit Court of Appeals, and arguments before a three-judge panel are set to be heard in Pasadena, California, this Friday.
Congress, with the vote of President Barack Obama — who was an Illinois senator at the time — subsequently legalized much of the warrantless spying in the summer of 2008. The legislation also provided the nation’s telecommunication companies immunity from lawsuits accusing them of being complicit with the government’s warrantless wiretapping.
The Obama Administration claims said it cannot be held liable under the Foreign Intelligence Surveillance Act*, and that Congress has not waived sovereign immunity — meaning the government has not consented to being sued for breaching its own laws.

A 17-year-old Texas honors student who was jailed for missing too much school because she had to work two jobs to support her siblings, refused to accept the more than $100,000 a website raised for her.
“We saw her trying to work and trying to go to school and trying to do all these things and then to have the judge put her in jail for missing school just seemed a little harsh,” said Paul Dietzel, who helped raise the money for Diane Tran. HelpDianeTran.com is a project of the Louisiana Children’s Education Alliance.
But Tran didn’t want the money: “There’s some other kid out there struggling more … than me,” she said.

Given the theme of my talk, I’d like to assert three things at the outset:
1. Revolution in this country is decisive to the success of the world socialist upheaval. The U.S. remains the capital of world capitalism, the epicenter of economic crisis, thief of labor and resources worldwide, noteholder to the debtor nations. It is the military life support for bourgeois dictators, armorer and financier of rightwing death squads, nuclear blackmailer of the world, breeder of fascism here and abroad, subverter of democracy and socialism on five continents. All those who aspire to be free must reckon with the capitalist dictators on Wall Street.
2. Revolution in the U.S. is coming sooner rather than later. The era of capitalist reforms, buyoffs, collaboration, and pacification of the working class is over. The economic, social, and political crisis of the profit system mandates austerity and repression and cannot but prepare the ground for mass certitude that revolution is the only way out, cannot but engender the desperate willingness of the broad working masses to take the revolutionary road—provided that revolutionary leadership is present at the head of the struggle.
3. U.S. Trotskyists are decisive to the success of the American revolution. Those who want freedom must win it. Only Marxism—the science of class struggle—lays the basis for common understanding of the revolutionary tasks at hand. Only Leninism—the method of welding a Marxist vanguard into a united striking arm against capital—can draw behind it the mass of workers and oppressed in a conscious and therefore implacable struggle for socialism. Only Trotskyism—rooted in Marxism and Leninism and standing on the theory of Permanent Revolution—can delineate the contours, dynamics, vicissitudes, and complexities of revolution in our time, organize the oppressed, and lead them to victory.
